MDA Consulting (Pty) Ltd (“MDA”) is a multi disciplinary consulting company which was established in May 2000 and provides legal and commercial consulting services in relation to all aspects of construction, engineering and mining contracts to Employers and Contractors alike through offices in both Johannesburg and Durban. 

MDA specialises in construction law and provides independent commercial and contractual advice aimed at minimising and managing the risks associated with projects.

At MDA we are committed to creating long-term, sustainable relationships with our clients.  We provide a professional, objective and value added service of the very highest standard specifically tailored to meet our clients’ individual requirements.

  Directors

Ian Massey    

Ian Massey is a civil engineer with 18 years contracting and over 20 years commercial and contractual consulting experience. He has worked with some of Southern Africa’s largest contractors and employers as a consultant providing specialist services in the formulation, motivation and quantification, both for the promotion as well as the defense of, all forms of construction contract claims.

Ian’s depth of knowledge is evident from the range of types of construction and contract forms that he has worked with both locally and internationally. He has made a special study of, and is an expert in, the quantification of disruption and acceleration claims.

Ian is frequently appointed as an expert witness in arbitrations.

Ian regularly acts as a mediator and adjudicator.

Ian has presented both public as well as in house training workshops on such subjects as Construction Law, the various standard contract forms recommended by the CIDB  and construction claims.

Vaughan Hattingh    

Vaughan is an attorney with many years of experience in general practice. He has since made study of and specialized in construction law. This has included attending a course on project management and a stint in East Africa developing and project managing a process plant.

Vaughan has extensive lecturing experience and leads up the MDA training unit where he has held workshops on such standard form contracts as the NEC, GCC, Colto, JBCC and FIDIC forms.

He has considerable experience in formulating bespoke and adapting standard contract forms to a client particularly risk appetite.

Vaughan is an expert in all phases of the claim management process from the formulation of the claim through to applying Alternative Dispute Resolution (ADR) techniques to resolve such.

Euan Massey    

Euan began his career as a commercial litigation attorney specializing in construction related issues.  Since joining MDA in 2002, Euan’s experience has expanded into providing advice on capital project procurement strategies such as EPC, EPCM and agreed target cost contracts and is an acknowledged expert in contract drafting in general and collaborative contracts in particular. This experience enables Euan to add considerable value to the contracting process and as a result  Euan represents a number of major employers and contractors both locally and internationally.

Euan has also presented  numerous  training workshops both public and in house throughout South Africa dealing with topics such as construction contract law and the various standard forms of contract recommended by the Construction Industry Development Board. .

Euan is the South African representative for the Society of Construction Law, a UK based society focused on the study and research of construction law.”

Christopher Bennett    

Chris was admitted as an attorney in 2002 and  practiced as a commercial attorney for four year before joining MDA in mid-2006. His paralegal experience with Masons in London, a leading UK firm, specializing in construction and engineering law has stood him in good stead.

Since joining MDA Chris has accumulated valuable experience on  a range of construction contracts from railways to dams and road improvements and rehabilitation amongst others. Chris provides both commercial and contract advice including commercial risk analysis and on-site commercial support .

He has experience with all the contract forms recommended for use by the CIDB and has presented courses on  Construction Law and the NEC contract. “

Wesley Soutter

   

Wesley Soutter completed his legal studies at the University of Natal (Durban) in 2005.  He thereafter completed his articles at an established Durban firm, Geyser Du Toit Louw & Kitching Inc. where he received extensive experience in commercial litigation and corporate law.  He was admitted as an attorney in the beginning of 2008 and practised as an associate at the firm.

Wesley’s previous firm was on the Super-Panel for numerous banks and he also performed general litigation work.  His corporate experience provided a good backing to his new focus on construction and engineering law.

Niel Coertse    

Niel Coertse completed his LLB at Unisa in 2004.  Thereafter he completed his articles with Le Roux Viver & Associates in Johannesburg.  After qualifying as an attorney, Niel ran his own practice for a period of 3 years, focusing on commercial litigation, commercial law and family law.

Niel is in the process of completing his MCom (Business Management) Degree at the University of Johannesburg and aims to complete his thesis in 2009.

Niel’s legal and commercial background provides him with the skills necessary for a career in construction and engineering law.

Steve Du Toit    

Steve practised as an attorney for more than twenty years before establishing a consultancy as a specialist commercial lawyer in 2004.  Two years ago he turned his attention to construction law and until May 2009 was an executive officer of JBCC.  During his time with JBCC Steve presented seminars on the JBCC building agreements and headed a committee appointed to consider amendments for inclusion in future editions.  As a result he has established himself as an expert in the JBCC building agreements and their application.

Steve specialises in the drafting of commercial agreements for the construction industry and in the formulation, prosecution and the defence of construction claims.  He also presents public and in house seminars on contract law and its application to the construction industry as well as on the JBCC building agreements.
